These Terms of Service ("Terms") govern your access to and use of Termskit's service available at https://termskit.app/ (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

The Service may integrate with or link to third-party services. We are not responsible for third-party services and their availability, content, or practices. Your use of third-party services is governed by their own terms.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Termskit AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Some jurisdictions do not allow these exclusions. In those cases, our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold harmless Termskit, its affiliates, and personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.

You may stop using the Service at any time. We may suspend or terminate your access immediately, with or without notice, for any breach of these Terms or as required by law.

Upon termination, sections that by their nature should survive (e.g., intellectual property, disclaimers, liability, indemnification, governing law) will remain in effect.

We may update these Terms from time to time. Material changes will be communicated via email or a notice on the Service at least 14 days before they take effect. Your continued use after changes take effect constitutes acceptance.
